A. General regulations on visas for foreigners working in Vietnam in 2023 - 2024
1. What is a visa for foreigners working in Vietnam?
Visa for foreigners working in Vietnam is a long-term visa issued by the Vietnamese Government to foreigners for the purpose of working and is applied to those who meet the conditions for a work permit or are qualified to work according to the provisions of the Vietnamese Labor Law.
2. How long is the duration of a work visa for foreigners?
- The maximum duration of a work visa is not more than 3 months for short-term work without a work permit.
- Maximum term of up to 1 year (12 months) for foreigners granted work permits, exempted from work permits or investors.
Note: In case a foreigner wants to apply for a visa longer than 12 months (1 year), he/she can apply for a temporary residence card according to regulations with a term of 1 year to 10 years depending on each case.
3. Types of work visas for foreigners in Vietnam.
Foreigners working in Vietnam are granted 2 types of work visas: short-term work visas and long-term work visas.
- Short-term visa is a visa with a maximum duration of 3 months issued to foreign experts, managers and technical workers entering Vietnam to work with businesses and organizations in Vietnam, types of visas DN1, DN2.
- Long-term visa for foreigners working in Vietnam is a visa with a maximum validity of 1 year (12 months) applicable to foreigners with a work permit or a certificate of not being subject to a work permit with visa symbols LD1, LD2
Work Visa 1 (LD1) is a visa with a maximum validity of 1 year (12 months) issued to foreigners working in Vietnam with confirmation that they are not subject to a work permit
Work Visa 2 (LD2) is a visa with a maximum validity of 1 year (12 months) issued to foreigners working in Vietnam with a work permit
Note: In case the work permit is not valid for 1 year, the visa duration for foreigners will be the same as the work permit (Work Permit) duration.
B. Documents and regulations on visa application for foreigners working in Vietnam
- Law No. 47/2014/QH2013 - Law on entry, exit, transit and residence of foreigners in Vietnam
- Circular No. 04/2015/TT-BCA regulating visa application forms and temporary visas for foreigners
- Decree 152/2020/ND-CP detailing the management of foreign workers and granting work permits to foreigners working in Vietnam
C. Visa application and visa extension for foreigners working in Vietnam
- Business and organization operating license (Business registration, Investment license, Branch and representative office operating license.....Businesses and organizations must submit in case of first time submitting documents at the Immigration Department)
- Certificate of seal use or Notice of seal use of the enterprise or organization with the Business Registration Office.
- Document introducing the seal and signature of the authorized person of the organization (NA16) . (Submit this declaration in case the company submits documents to the Immigration Department for the first time)
- Application form for visa issuance and temporary residence extension (NA5) for foreigners residing in Vietnam
- Entry approval form NA2 for foreigners currently abroad (Not yet entered Vietnam)
- Original passport with valid term as prescribed. (For foreigners currently in Vietnam)
- Certified copy of work permit (for LD2 visa) or Work permit exemption certificate for cases exempted from work permit (for LD1 visa)
- Temporary residence book or Temporary residence certificate of foreigner (In some cases, the Immigration Department will request)
Note: For foreigners who are Chinese or Taiwanese, an additional 3cmx4cm photo is required to be issued a separate visa.
D. Submitting work visa application for foreigners
In Vietnam, companies and organizations that submit long-term visa applications for foreigners must complete procedures at the Immigration Department or the Immigration Department of the provincial or municipal police where the company or organization has its headquarters.
In addition, businesses and organizations can submit applications online at the National Public Service Portal and the Ministry of Public Security's Public Service Portal with the prescribed procedures.
E. Time to process visa application for work visa
The processing time according to current regulations is 05 working days from the date of submission of valid documents. The time to receive visa results will be clearly stated in the receipt when the enterprise or organization submits the application at the one-stop department at the Immigration Department.
