​INSTRUCTIONS ON PROCEDURES FOR TEMPORARY RESIDENCE DECLARATION FOR FOREIGNERS IN VIETNAM USING TEMPORARY RESIDENCE DECLARATION FORM (COMMUNE LEVEL)

Step 1: The temporary residence declarant receives the temporary residence information of the foreigner.

Step 2: Declare and submit the Temporary Residence Declaration Form to the on-duty police station of the commune, ward, town or police station (hereinafter referred to as the commune-level police) where the accommodation is located (The Temporary Residence Declaration Form can be sent in advance by fax or information can be notified by phone to the on-duty police station of the commune).

The officer on duty at the commune-level police station receives the application and checks the legality and content of the application:
If the content of the Temporary Residence Declaration Form for Foreigners is fully filled in, it will be accepted and confirmed according to regulations;
If the content of the Temporary Residence Declaration Form for foreigners is not fully filled out, the temporary residence declarant is required to make corrections and supplements.

Step 3: The temporary residence declarant immediately receives the Temporary Residence Declaration Form confirmed by the on-duty police officer at the commune level.

- How to do it: directly at the commune police headquarters.

- Components and number of documents:
+ File components: 01 Temporary residence declaration form for foreigners (form NA17).
+ Number of documents: 01 (one) set.

- Processing time: 24 hours/7 days.

- Subjects performing administrative procedures:
Temporary residence declarants as prescribed in Article 3, Circular No. 53/2016/TT-BCA dated December 28, 2016 of the Minister of Public Security stipulating the method of declaring and receiving temporary residence information of foreigners in Vietnam.

 - Administrative procedure performing agency: Commune-level police.

- Results of administrative procedure implementation: Temporary residence declaration form is confirmed by the police agency and temporary residence declaration information has been received and recorded in the duty book of the commune-level police.

- Name of application form, declaration form (if any): Temporary residence declaration form for foreigners (form NA17 issued with Circular No. 04/2015/TT-BCA, dated January 5, 2015 of the Ministry of Public Security). 

- Requirements and conditions for performing administrative procedures (if any):
The temporary residence declarant must submit the Temporary Residence Declaration Form within 12 hours, and within 24 hours in remote areas from the time the foreigner arrives to register for temporary residence.

+ Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam (Law No. 47/2014/QH13, dated June 16, 2014).
+ Circular No. 53/2016/TT-BCA dated December 28, 2016 of the Ministry of Public Security regulating the method of declaring and receiving temporary residence information of foreigners in Vietnam.
+ Circular No. 04/2015/TT-BCA, dated January 5, 2015 of the Ministry of Public Security stipulating forms of documents related to entry, exit, transit, and residence of foreigners in Vietnam.
